Terms and Conditions
1. Object
1.1. These General Conditions, updated in January 2023, together with the order form and other elements mentioned therein, regulate the terms and conditions for the provision of the Online Store Service of CABRITA WINES (José Manuel Cabrita), headquartered at Quinta da Vinha – Sítio da Vala, 8300-032 Silves, under fiscal identification number 110 666 208, hereinafter referred to as CABRITA WINES.
1.2. The purchase of any product from CABRITA WINES’ Online Store implies acceptance of these General Online Sales Conditions.
1.3. All alcoholic beverages available for sale in CABRITA WINES’ Online Store may only be purchased by individuals of legal drinking age in their country of residence.
2. Product Information, Prices and Content
2.1. CABRITA WINES reserves the right to modify, without notice and at any time, the commercial information and offer presented regarding products, prices, promotions, commercial conditions, and services.
2.2. The images illustrating each product on CABRITA WINES may differ from the product subsequently delivered and these same products are also subject to stock depletion.
2.3. Despite CABRITA WINES’ efforts, some products may have an inaccurate price, which is why the company verifies prices whenever it processes orders. Therefore, the prices displayed on CABRITA WINES are merely indicative and do not constitute a contractual proposal. If the actual price of the product is lower than the advertised price, CABRITA WINES will refund the difference. If the price is higher, CABRITA WINES will inform the customer by email and await their decision to accept the new price or cancel the order within 15 days from the date the email was sent.
2.4. Under Portuguese law, all prices displayed on CABRITA WINES include the respective VAT rates in force, unless otherwise indicated.
3. Ordering and Payment
3.1. After confirming the order on CABRITA WINES, an email will be sent to the contact address registered by the customer at the time of formalization, with all the details about delivery, billing, payment information, products, and values. CABRITA WINES suggests that all customers confirm the details of the order. If the customer does not receive the order confirmation email, they are requested to contact CABRITA WINES through our email reservations@cabritawines.com so that the notification can be resent to the customer’s email address.
3.2. If any of the details provided by the customer in the order are incorrect and/or the customer wishes to change any information, provided that the order has not yet been dispatched, the customer is requested to contact reservations@cabritawines.com as soon as possible so that the requested change can be made internally. Changes to details of already dispatched orders will have to be analyzed by CABRITA WINES’ team so that, together with the customer, the most appropriate solution can be found.
3.3. All orders on CABRITA WINES will only be processed after effective receipt of payment. Formalizing the order alone does not constitute a reservation of the products.
3.4. If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by CABRITA WINES to find the most appropriate solution.
3.5. All orders placed on CABRITA WINES will be subject to immediate payment.
3.6. Orders may be canceled when expressly requested by the customer through one of our contacts, before the orders are shipped. After the order is confirmed as shipped, the customer is requested to contact CABRITA WINES so that the most appropriate solution can be found together.
3.7. Payments by credit card are accepted through the CABRITA WINES Online Store.
3.8. Orders at CABRITA WINES, regardless of the day they were requested, will always be shipped by carrier on Fridays.
3.9. Payments are received in euros, regardless of the currency in which the transaction is made. Conversion rates for payments made in other currencies will be borne by the customer.
3.10. In some cases, our customer support department may request documents in order to proceed with the processing of the order.
4. Shipping Fees
4.1. To the prices shown on the products, the respective transport cost is added, which depends on the weight of the order and the respective delivery destination. This postage value can be simulated within the shopping cart with the intended products added and filling in all the requested fields of the simulator. The total postage will also be automatically calculated when placing your order on the Online Store. It should be noted that the factors in this calculation may be variable and change without prior notice.
4.2. Due to our logistic procedures and shipment policy, the cost of shipping one product is equal to the cost of shipping six (or multiples of six) products in each order.
5. Shipments and Deliveries
5.1. For orders to be sent to the requested address, all required fields must be filled in.
5.2. In general, after shipment, an order at CABRITA WINES takes time to be delivered:
– About 72 hours (working days) in mainland Portugal;
– Approximately 15 working days in Madeira and Azores Islands;
– About 4 to 7 business days in Peninsular Spain;
– About 6 to 9 business days in the rest of Europe;
– Approximately 15 business days in the rest of the world.
5.3. After the shipment of orders, the information for tracking the shipment will be sent through a notification via email with the information of the link for tracking the shipment. If for some reason the customer does not receive the shipment confirmation, he must contact CABRITA WINES through our contacts so that all available information on the shipment of the order is sent again.
5.4. After notification of dispatch, customers must monitor the status of the shipment through the link provided by CABRITA WINES, so that they are aware of the status of evolution until the moment of delivery of the order, since CABRITA WINES does not notify each change shipping status.
5.5. All products shipped by CABRITA WINES must be checked upon delivery. If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return on the carrier’s delivery note and immediately notify CABRITA WINES through our contacts.
5.6. If, after delivery, the customer verifies that any of the items are not in conformity, he is requested to contact CABRITA WINES immediately through the email reservas@cabritawines.com indicating the order number or the number of the document that accompanied the delivery. order, attaching images of the packaging as received and of all items, so that the process of investigating the occurrence is opened internally and in this way the situation can be resolved as soon as possible.
5.7. CABRITA WINES is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. Customers are responsible for any seizure of their orders, as well as the payment of customs fees, if any. In case of returning the products, CABRITA WINES will only refund the amount corresponding to these same products. In case of doubt, the customer can contact CABRITA WINES before ordering.
5.8. CABRITA WINES has contracted services with specialized carriers for deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be unrelated to CABRITA WINES, and it is not possible, in these cases, to guarantee exact delivery times.
5.9. Most deliveries are made during office hours on working days at the shipping address indicated by the customer when placing the order.
5.10. In the event of an unsuccessful delivery attempt by the transport company due to absence, a note of passage is always left in the customer’s mailbox with the carrier’s instructions. Depending on the service and the carrier, orders must be picked up at the location indicated by the same in the passage notice, or the indications requested in the same notice must be followed.
5.11. If for some reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact CABRITA WINES so that together the most appropriate solution can be found.
6. Applicable Law
6.1. CABRITA WINES recognizes to all its customers the right to terminate the contracts they enter into with it, allowing them to return, within a period of 30 (thirty) days, the products purchased under the terms of Decree-Law n.º 109-G /2021 and Decree-Law No. 84/2021, of December 10, 2021.
6.2. For exchanges or returns, the customer is requested to contact CABRITA WINES via email reservas@cabritawines.com indicating the order number or the document that accompanied it, taking into account the conditions detailed below in the following topics:
a) To return the order, the product must be in perfect condition, and where appropriate with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b) The return of defective products and mistaken shipments will be admitted, CABRITA WINES being responsible for the shipping and collection costs whenever the customer communicates this circumstance within a period of 30 (thirty) days from the date of receipt of the product.
c) Once the goods are received at our facilities and after validation of the condition of the same, the value will be refunded according to the payment method made by the customer, or another solution previously agreed with the same.
6.3. CABRITA WINES assumes responsibility arising from defects in the origin or raw material of the product purchased and if this is confirmed by the specialized team at CABRITA WINES, the product will be exchanged or returned at no cost to the customer.
6.4. CABRITA WINES will not accept the return of the product after it has been used, or if it has been altered or modified.
6.5. CABRITA WINES is not responsible for deficiencies arising from incorrect use, negligence, poor storage conditions or causes of force majeure.
7. Applicable Law
7.1. All purchases made on the CABRITA WINES website are subject to Portuguese legislation. Any conflict or divergence of interpretation of the General Online Sales Conditions will be submitted to the competent Portuguese Court.
7.2. If the Customer is located outside Mainland Portugal, CABRITA WINES informs from now on that any judicial process must be exclusively initiated in the Portuguese Courts.
7.3. Under the terms and for the purposes of the provisions of art. 18 of Law n.º 144/2015, of September 8, it is informed that the ADR entity available is the Consumer Dispute Arbitration Center of Lisbon, with the following contacts:
